AGPIL Manager Private Limited & AGPIL Advisors Private Limited (hereinafter referred to as “AGP Logistics”, “AGPIL”, “we”, “our”, or “us”), together with its current and future subsidiaries, affiliates, joint ventures, limited partnerships, and managed funds (collectively referred to as the “AGPIL Group”), is committed to protecting your privacy and handling your Personal Data responsibly. This Privacy Notice (hereinafter referred to as “Notice”) explains what Personal Data we collect through the “Contact Us” page of our website, how we use it, and your rights.

Before using our website or availing any of our services, you are advised to carefully read this Notice. If you do not agree with the terms of this Notice, please do not access this website. By visiting and/or using our website, you consent to the processing of your Personal Data in accordance with this Notice

2. Types of Information Collected

When you interact with us, we collect different types of information from you based on the type of interaction.

  • When you fill out the “Contact Us” form, we collect the following information:

    • Email Address
    • Organisation
    • Phone Number
    • Type of Enquiry
    • Message/Details of Enquiry

The following elements are considered as “Personal Data,” which means any data about an individual which alone or in combination with other elements can identify the individual.

  • Additionally, technical data such as IP address and other elements may be automatically collected for various purposes.

  • Our website is not intended for use by individuals under 18 years of age. We do not knowingly collect or Process Personal Data of children. If you believe that we have inadvertently received such data, please contact us to ensure its deletion from our systems.

3. Purposes for Processing your Personal Data

“Processing”, “Processed”, “Process” in relation to Personal Data, means a wholly or partly automated operation or set of operations performed on digital Personal Data, and includes operations such as collection, recording, organization, structuring, storage, adaptation, retrieval, use, alignment, or combination, indexing, sharing, disclosure by transmission, dissemination or otherwise making available, restriction, erasure, or destruction.

We Process your Personal Data to;

  • respond to your enquiry
  • provide information about our services and offerings.
  • contact you regarding your request.
  • maintain internal records for business operations.
  • better understand how you interact with our website, including its functionality and features, and ensure that content is presented in the most effective manner
  • keep records
  • establish, exercise, or defend a legal claim; and
  • use the data for any other purpose related to the above.

4. Lawful basis for Processing Your Personal Data

We only collect and Process Personal Data about you where we have a lawful basis. Lawful basis on which we would Process data from you includes:

  • Obtaining explicit consent from you, where applicable
  • For Legitimate Uses where Processing is necessary for the purposes specified under section 7 of DPDPA, namely:
    1. Where you voluntarily provide your Personal Data for a specific purpose and have not indicated that you do not consent to its use, we may Process such data solely for that purpose.
    2. When required to fulfil any obligation to disclose information under a law currently in force in India.
    3. Where Processing is necessary to comply with any court order, judgment, or legal obligation under Indian law or applicable foreign laws for civil or contractual matters.
    4. To respond to a medical emergency involving a threat to life or immediate threat to the health of any individual.
    5. For providing medical treatment or health services during an epidemic, outbreak, or any threat to public health.
    6. To ensure safety, provide assistance, or deliver services during disasters or breakdowns of public order, as defined under the Disaster Management Act, 2005.
    7. Where Processing is required for employment-related matters or to protect the employer from potential loss or liability. This includes purposes such as prevention of corporate espionage, protection of intellectual property or trade secrets, and provision of employee benefits or services.

To the extent of any conflict or inconsistency between the provisions of this Notice and the cookie policy with respect to the use of cookies, the provisions of the cookie policy prevail.

6. Data Retention

It is our policy to retain your Personal Data for the length of time required for the specific purpose or purposes for which it was collected, in accordance with applicable law and only until it is necessary.

To determine the appropriate retention period for Personal Data, we consider the amount, nature, and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we Process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal requirements.

7. Disclosing your Personal Data

Your Personal Data may be used, disclosed, maintained, accessed, Processed, and/or transferred to our parent company, subsidiaries, and affiliated companies. AGPIL shall be primarily responsible for management of the shared Personal Data.

In addition, your Personal Data may be used, disclosed, maintained, accessed, Processed, and/or transferred to the following third parties, whether located in your jurisdiction or outside of your jurisdiction, for one or more of the purposes set out above:

  • Courts and other alternative dispute forum
  • Third-party service providers which require the Processing of your information, for example, third-party service providers which have been engaged by us to provide and maintain any IT equipment and cloud computing system used to store and access your Personal Data; or

Where we provide your Personal Data to third-party services providers, they are required to keep your Personal Data confidential and secure and are instructed to use your Personal Data only as specified by us.

We may also disclose your Personal Data where required to respond to authorised requests from public and government/regulatory authorities, statutory boards or where required by any applicable law, including for reasons of national security. Where required by applicable law, we may also disclose your Personal Data where necessary to enforce agreements, to investigate or protect our rights.

8. Keeping your Personal Data Secure

We implement reasonable technical and organizational measures in relation to the data and Personal Data that is Processed by us. We take reasonable measures to protect all Personal Data from unauthorized Processing or accidental disclosure, alteration, misuse, destruction or loss or unauthorized access and modification that compromises the confidentiality, integrity, and availability of such data.

While we endeavour to always protect our website, operations and data against unauthorized access, use, modification, and disclosure, due to the inherent nature of the internet, we cannot guarantee that any data, during transmission or while stored on our systems, will be safe and secure from intrusion by others. However, In the event of a Personal Data breach, we will promptly notify the Data Protection Board of India and, where applicable, the affected individuals, in accordance with the applicable laws and regulations.

9. Storing and Transferring your Personal Data

Your Personal Data may be transferred to and stored on secure servers located outside India. These transfers may occur to countries where our group entities are located. All such data transfers made outside India, will only occur to jurisdictions not restricted by the Government of India and subject to appropriate technical and organizational measures to safeguard your data.

It may be Processed by and transferred to the AGP group (“Group”) staff. By submitting your Personal Data to us, you agree and consent of such transfer, storing and Processing.

10. Your Rights

We respect your rights in relation to your Personal Data, and we will respond to requests to exercise your rights under the DPDP Act. Where applicable, we will take reasonable steps to fulfil your request.

You have the following rights:

  • Right to access data: You can contact us for a summary of your Personal Data, the Processing activities undertaken with respect to such Personal Data, the details of all other data fiduciaries and data processors with whom your Personal Data has been shared by us along with the description of the Personal Data so shared, and any other information related to its Processing
  • Right to request correction: If your Personal Data is incomplete, inaccurate, misleading, or out of date, you can inform us about the same and your Personal Data will be corrected, completed, or updated upon due verification
  • Right to request erasure: If you believe that we should discontinue the use of your Personal Data, you have the option to request the deletion of your Personal Data, unless retention is necessary for compliance with applicable laws for the time being in force
  • Right of grievance redressal: You have the right to raise grievances regarding the Processing of your Personal Data. In case of any grievance, you can seek redressal of the same by reaching out to us. If you are not satisfied with the resolution provided, you may lodge your complaint with the Data Protection Board established under the DPDPA Act as mentioned below.
  • Right to nominate: In the event of your death or Incapacity, you can nominate any other individual to exercise such rights on your behalf
  • Right to withdraw your consent: You can withdraw your consent easily by emailing us on the contact information provided in Clause 12.

The consent previously granted for the Processing of Personal Data will remain valid until you withdraw it. It will not affect the lawfulness of the Processing until the withdrawal. However, opting out may result in cessation of the respective engagement or services.

We may require reasonable time to fulfil your right to withdraw consent, and we shall notify you regarding the fulfilment of the request and its consequences of us acceding to the same, including any legal consequences which may affect your rights and liabilities to us.

For exercising any of your rights, you can contact us using the information provided in Clause 12. We will need you to furnish proof of your identity before you can exercise these rights. We may not be able to execute any requests made in the event you fail to establish your identity, or if we are unable to authenticate your identity.
If you are unsatisfied with the response to your request, you have the right to lodge a complaint with the Data Protection Board of India (herein after referred to as “Board”).

11. Complaints

You may contact us at any time if you have any questions or concerns about this Notice or about the way in which your Personal Data has been handled.

You may make a complaint to our local data privacy officer using the contact details set out in clause 12 of this Notice. Our local data privacy officer will first consider your complaint to determine whether there are simple or immediate steps which can be taken to resolve the complaint.

Your complaint will then be investigated. We may ask you to provide further information about your complaint and the outcome you are seeking. We will then typically gather relevant facts, locate and review relevant documents and speak with individuals involved.

In most cases, we will investigate and respond to a complaint within a reasonable time, usually within 30 days of receipt of the complaint, or as otherwise required under applicable law. If the matter is more complex or our investigation may take longer, we will notify you regarding the same.

This right to make a complaint does not affect your statutory right under DPDPA to complain to the Board if you feel we have infringed your rights. Information and contact details for the Board can be found above in section 10.

12. Changes to this Notice

Any changes to this Notice in the future will be posted on this page and, where appropriate, notified to you. The changes will be effective from the date of posting.
